Terms and Conditions of Sale and Purchase

These Terms and Conditions of Sale and Purchase ("Terms") set forth the terms and conditions on which you are permitted to purchase the goods and services that together comprise the “CIMAplus” package from the Chartered Institute of Management Accountants (CIMA) through its web site at www.cimaglobal.com ("Site").

If you submit an order for CIMAplus from this Site, this shall be taken to constitute acceptance by you of these Terms.

1. Contract Formation

1.1 If you wish to purchase any of the goods or services for sale on this Site, you must submit a completed online order and arrange full payment. You will be required to select your goods or services for purchase and complete your delivery and payment details via your "My CIMA" account. Once these have been completed, you will have a further chance to check (and correct if necessary) these details prior to submission of your order.

1.2 If we agree to accept your order, you will be sent an email giving you an order reference ("Email Confirmation") and you should print out the page containing this and your other order details for your future reference. Once we have sent this Email confirmation, you will not be able to amend or cancel your order (subject to your right of withdrawal as described below) or access your original order form.

1.3 CIMAplus is only available to be purchased for personal use, and not for resale.

1.4 We may correct any error in any unconfirmed order, sales literature or other document or information issued by us or placed on this Site without any liability.

1.5 At this time, English is the only language offered by this Site for the order process.

2. Right of Withdrawal

2.1 Where you purchase items from this Site for personal use and not for resale:

i You have the right to withdraw from the purchase from the date on which we send you our Email confirmation until fourteen (14) days after the day you receive your order by giving us written notice of withdrawal by e-mail.

3. Prices (including taxes and delivery) and Payment

3.1 The price of items shall be that quoted on this Site on the date you place your order, subject to any inadvertent pricing errors. While we make every effort to ensure that prices quoted on the Site are accurate, if there has been an inadvertent error, the correct price will be stated in the Email Confirmation and you will have the opportunity to withdraw from the order at that stage if the correct price is higher than that quoted and you are not happy with that higher price. The price also excludes any applicable Value Added Tax or other sales tax, which will be stated separately on the Site.

3.2 Payment shall be made by credit card or debit card on the date we accept your order.

4. Subscription period

4.1 The subscription period for CIMAplus shall be for one calendar year (twelve months) from January to December subject to any changes that may be communicated in writing.

4.2 Only 2 courses can be selected in any given subscription period.

5. Delivery

5.1 The resources within CIMAPlus are all available online.

6.0 Consumer Protection

61. Where any goods or services are sold on this Site to persons dealing as a consumer, your statutory rights are not affected by these Terms and Conditions. Furthermore, nothing in these Terms and Conditions shall exclude or limit our liability arising by virtue of consumer protection legislation, or our liability for fraud or for death or personal injury caused by our negligence or any other liability to the extent that we cannot so exclude or limit such liability as a matter of law.

6.2 The online courses element of CIMAplus is delivered by the CGMA Store. In order to confirm you are a CIMAplus subscriber, CIMA supply the CGMA Store with basic personal information about you i.e. your name, contact ID and email address. By signing up to CIMAplus you are consenting to CIMA passing this information about you to the CGMA Store.

7. Accuracy of content

7.1 Whilst we try to ensure all information on the CIMAplus website is correct, up-to-date and complete, such information is provided for information purposes only and you should not rely on it. Accordingly, we make no warranty as to the accuracy of any information or contributions on the CIMAplus website and any links to third party websites and do not accept any responsibility for any errors or omissions, or for any damage or loss you may suffer.

If at any time you believe that we have not adhered to these Terms or you have a complaint regarding the way your order is being handled, please contact CIMA's Customer Services Department. Disputes under these Terms will be resolved by CIMA’s Customer Services Department, which will use commercially reasonable efforts to promptly investigate and, if necessary, to correct any problem.

9. General

9.1 The agreement shall be governed by the laws of England and Wales. In the event of any inconsistency between these Terms and the Terms and Conditions of the Site, these Terms shall prevail.

9.2 Moreover, once the order has been completed, the "Email Confirmation" described in the above Terms and Conditions of Sale and Purchase will be sent to the customer. In addition to giving an order number, this confirmatory email will repeat the information required under the Consumer Contracts Regulations, to ensure compliance with these Regulations, specifically:

i supplier's identity;

ii description of the goods purchased;

iii price;

iv arrangements for delivery; if appropriate;

v details about cancellation rights;

vi about arrangements for returning goods in the event of cancellation by the customer if relevant; and

vii contact details for customer services.
