Operating a website in a commercially sound and compliant manner requires businesses to negotiate a minefield of increasing complex legal issues. During this course the key legal considerations will be reviewed in detail and a series of case studies will be reviewed by delegates.

  • Understand the key considerations that apply when reviewing and revising website development and hosting agreements
  • Review and revise a website linking agreement
  • Comprehend the rules that apply to ‘distance contracts’ in an online context and apply them to a series of practical exercises
  • Understand the potential pitfalls in respect of domain name registration and the various ways in which disputes can be resolved
  • Apply the rules on online defamation to a series of case studies

Programme outline

  • Website development, hosting and linking agreements – what are the issues that arise when drafting these agreements and what can be done to avoid disputes?
  • Contract formation – how does this work online and what needs to be done to minimise risk?
  • Distance contracts – what are they and what are the rules about provision of information and cancellation?
  • Domain names and intellectual property – how can intellectual property rights be protected? What dispute resolution mechanisms are available in the event of a dispute?
  • On-line defamation – how do the rules concerning defamation apply in the online sphere? Are the rules applied differently in respect of twitter and Facebook?
  • Emphasis throughout is placed on a commercially sound and compliant approach to these topics and the course will involve a series of practical exercises analysing each of the areas covered. Group feedback will be given.

The course starts at 9.30am. Lunch and refreshments are included.
